Therefore, the first article, the municipality of Santos, is an insoluble union of the state of São Paulo, Federative Republic of Brazil, constituted within the democratic rule of law and sphere of local government, in the

full use of its political, administrative and financial autonomy, governed by this organic law voted on and approved by the Chamber, under the terms guaranteed by the Federal and State Constitutions. So, one important thing that we need to understand, right? Well, Santos is a city that is part of the Federative Republic of Brazil, and we have the

Constitution, which is our supreme law. So, everything we think and do has to be based on the Constitution, okay? A municipal law cannot contradict what is in the Constitution. So this is a way for us to learn the laws, to really understand them, and when you see something strange there in relation to the Constitution, it's good

to be aware, right, because there could be a problem. We're going to discuss this here, right? First paragraph. Municipal action is carried out throughout its territory, without privileging districts or neighborhoods, eliminating regional and social inequalities, promoting the well-being of its inhabitants, without prejudice based on origin , sex, color, age, or any other

form of discrimination. So, when we talk about the idea of the law, the principles, it's right here, clearly stated in the first paragraph, no discrimination, no inequality, the treatment, right, of the territory must be equal. It can favor one over another, although we know that in practice, some neighborhoods end up being looked after more

than others, at least that's the feeling the population has. But, in short, the law, what we need to focus on here is that the law guarantees this, right? And we answer each other in the exam according to the law. Well, popular sovereignty, you know, manifests itself when everyone is guaranteed dignified living conditions and will be exercised. Paragraph

two, then, through universal suffrage and direct voting, right? So, the choice of political representatives, mayor, councilors, right, by secret ballot, as it is throughout Brazil, and by plebiscite and paragraph uh, clause two here regarding relevant issues, when at least 1% of the electorate requests a hearing from the Regional Electoral Court. people? Sometimes you have a situation that is quite controversial, and then you need a plebiscite, right? Well, article 2 states that the legislative and executive branches are independent and harmonious powers of the municipality . So we have two branches of power: the legislative branch, which is that of the city councilors, the president of the council, and the executive branch, which includes the mayor, the secretariats, and other branches of government. All things are assets, rights and shares, regardless of title, that belong to the municipality, land, right? thinking, "Oh, what is vacant land?" These are public lands, right? Areas that belong to the government, uh, don't have a function, but are government, or absent private domain. Anyway, you don't need to worry about that issue because it won't happen. You need to know that the municipality has unclaimed lands, right, located within

its territory, okay? So, these are the assets of the municipality. It's also important for you to understand that this is an exclusive competence, something that belongs solely to the municipality. We have state-owned equipment, like AM, for example, which is

equipment owned by the state government. Sometimes we have equipment from the federal government, you know, like we have, for example, the Federal Institute, we'll have it, right? So, these issues are shared by us, right? To promote, where applicable, adequate territorial planning through the planning and control of land use, subdivision, and occupation of urban land, this organization of the

territory is the responsibility of the municipality. Promoting the protection of historical and cultural heritage while observing federal and state legislation and oversight , right? historical heritage. Santos is a city with a lot of historical heritage, right? The city center, theaters, well, we have many things that are historic, right? Even the center of Santos is used in

several films, right? The girl at the café over there, that setting is for movies that want to give off a certain vibe, you know? Uh, from the 1900s, right? 1900s and something, 1800s, well, you know? Well, at the end of the 19th century, for example, the goal was to develop and implement urban development policy with the objective of

We have a very big discussion regarding the size of buildings, right? So this will go in the

The Municipal Civil Guard is also responsible for planning and promoting

permanent defense against public calamities and legislating on bidding and contracting in all modalities for the direct and indirect municipal public administration , including public foundations and private companies. Sometimes this kind of issue comes up, but it's not very common,

State and federal. Well, shared jurisdiction, right, which is what

So, look, upholding the constitution, the laws, preserving the historical heritage— that's a shared responsibility between the federal and state governments— taking care of health, public assistance, and the protection of people with—here I

I am not a legislator, I cannot change the law. I accept the law as it is, including the errors, right? We sometimes have errors, like

It's only the legislators who can correct and protect documents, works of art, other assets of historical, artistic, and cultural value , monuments, landscapes , and archaeological sites, right? Here in Santos, we also aim to prevent

the removal, destruction, and alteration of works of art and assets of historical, artistic, and cultural value, and to provide the means of access to culture, education, and science. So it is the responsibility of the federal government, the municipality, and the state to protect the environment, combat pollution, and preserve forests, wildlife, beaches, mangroves, and

coastal areas, right? To promote agricultural production, food supply, to promote housing construction programs , improvement of housing conditions, basic sanitation, all of that, right? Well, basic sanitation is a company that's now privatized, right, owned by the state, Sabesp, anyway, combating the causes of poverty, factors of marginalization, promoting integration, registering, monitoring, and overseeing the granting of

rights, exploitation of water resources, establishing and implementing traffic safety education policies, and so on, right? So you can see that this always has a relationship. Fabio, how do I identify that? You will always see it this way: local interest, it's obviously an exclusive competence. Maintaining technical cooperation is an initiative, right? Eliminate the district,

organize the territory, right? Let's think about it, think of a simple example here, the organization of taxi stands, bus stops, uh, the bus stops, right? Well, traffic management, that's all a municipal responsibility, right? Collecting municipal taxes, right? I don't see any distinction there between one, this one is more, this one is less, right? I know that many times, culturally, there's even an

anthropologist, Roberto da Mata, who wrote a book, that this is a cultural issue in Brazil, right, which is, uh, you know who you're talking to as if that person were superior to the other, right? So this cannot happen in the public sector . Morality is the publicity of your actions, right? Morality, I

need efficiency and the public interest, always placed there as a principle. OK? And then we have the organization of the administration. So, the organization of public administration, whether direct, autonomous, mixed-economy, company, housing, or foundation, is required to comply with the following rules, right? As stated in point one, public positions, jobs, and functions are accessible to

Brazilians who meet the requirements established by law. Paragraph two, the applicant for a position in the public sector depends on prior approval through a competitive examination or a competitive examination and evaluation of qualifications, except for appointments to positions and commissions declared by law to be of free appointment and dismissal. And then you say, "Ah, so it's against the law, right?" Well, legally no, because that's a discretionary power of the municipality, okay? So, the municipality

opted for this, but it remains that way in the organic law . So, I've included this document explaining how you should proceed. If you ask according to article 67, right, the validity period, you'll go to clause three, 2 years, renewable once for an equal period, right? If the question is in accordance with the terms of the notice, it's for one year, which can

be extended for another year, okay? So, uh, I know it seems confusing, but in the end there's a legal explanation in this document for you, and about that, right? Ideally, the organic law would undergo a change here, right? Anyway , okay? I know it's controversial, but we respond according to the law, and I don't think the examiners will cause any

trouble. In the official announcements, this is always for one year, renewable for an equal period, okay? So , another year, right? The city of Santos has not adopted a 2-year extension for an equal period, meaning two years for an equal period plus two more, right? It would be 4 years. You haven't been doing that, have you? And

that's a matter of administrative discretion, okay? Well, anyway, right? I haven't seen it; they may have changed it in some internal document, but in the law that we're studying, there hasn't been any change, okay? The last change was in 2017. So, all the public notices, the most recent ones for inspector, secretary, and all those notices, are for one year, renewable for another year, okay? And here it states: within the non-extendable deadline stipulated in the

call for applications, those who passed the competitive public examination will be called upon with priority over newly qualified candidates to assume a position or job in the career, okay? During the deadline, right? The city hall will summon someone, but there's another controversy here. Ah, professor, but sometimes the city hall calls, or doesn't call, people like that,

it needs to call what's in the public notice, right, and the vacancies that are created and opened. And often, as we get closer to the end, a new competition ends up opening up, right? This always causes controversy. Well, for example, the number of positions and teachers is quite high, right? They're going to have to

call that number. They can't call less, so they have to call that number. And anything else that comes after is fine, right? Appointed positions and positions of trust will be filled in the cases and conditions stipulated by law, preferably by tenured civil servants in technical or professional careers who have been registered to vote in that municipality for

more than 2 years, okay? So, according to clause 5, right? The preference is for career civil servants, right? Well, six, public servants are guaranteed the right to free union association, right? So, everyone has that right. Seven, the right to strike will be exercised under the terms and limits defined in federal supplementary law. Up until now,

this hasn't been defined by federal law, right? The right to strike belongs to public servants, but the Supreme Court, and other judicial bodies, base their decisions on the right to strike belonging to employees in the private sector. Well, eight, public employee, reason for job stability, provided that the registration of their candidacy for the

exercise and position of union representation or, in the case of item 31 of this article, up to one year after the end of the term, if elected, unless they commit a serious offense, right? what we call the salary cap, meaning no one can earn more than the mayor, right? The mayor is the highest authority, okay? So, sometimes an employee, in their own career, progressing there, taking this course, blah blah blah, getting a doctorate, their value goes beyond that, then it hits the ceiling, right? He cannot win. That's what's called a salary

cap, which means your salary goes up to that point; you can't earn more than that . Unless the mayor gets a salary increase and yours does too, we call it unlocking the salary cap, right? So yours goes up too, right? 13. Until it reaches the limit and almost refers to what is referred to in the previous paragraph, it is forbidden to

reduce salaries in a way that implies the elimination of individually acquired benefits. Upon reaching the aforementioned limit, the reduction will apply regardless of the nature of the benefits offered by the employee. It's what I explained in other words, right? In other words, you fall under the salary cap, and the salaries of the legislative branch

cannot exceed those paid by the executive branch, right? So, chamber and uh executive power. The linking and equalization of salaries for the purpose of remunerating public service personnel is prohibited, except as provided in paragraph e of article 73, right? I'll just explain it here. It's very rare to fall, but it's worth explaining.

Public servants' salaries are non-reducible, and remuneration will comply with clauses 11, 12, 14, and 15. Therefore, there can be no

salary reduction, okay everyone? Even when a person is reassigned to a different role, their salary cannot be reduced, nor can they start earning more, right? And here, oh, controversial grandma. Well, the law hasn't been changed yet, but the Constitution, article 37, has already been amended.
