>> Hi everyone, how you doing? Brit Simon here. Good evening to you. Um, some of you will have uh been listening to the Madani hearing just now. Um, uh, and so I thought I'd I'd come live and uh, um, take any questions and talk about what I heard and see if you heard the same as

me. Um, what are my impressions? First impression of what I heard. Um, it's very difficult for me uh to listen into um a hearing like that because and I'm glad I wasn't in the room. Um uh bec because I I'm trying not to sound arrogant, but anyway, I know this subject back to

front. I know the data back to front. Um I was born arguing. I argued with my mother as I came out of the birth canal. I think I argued with the doctors, you know, I was born to argue. Um, and you know, I know the subject very well. So for me, um, to sit there and listen to,

um, the two lawyers and the judge sort of run going around in circles, um, on incorrect information drives me bananas. Um, absolutely bananas. Um, uh, very frustrating that the And but this is lawyer lawyer Lori Lori Lori Um, this is legal work. Um, uh, you know, Curtis can't jump up and punch the

other, uh, the other lawyer in the face every time the other lawyer says a lie, right? He can't do that. Um, that's not proper court decorum, right? And the and we have to sort of trust that the judge is smart enough to not be swayed by some of the [ __ ] that the government

lawyer was saying. And he was saying again some [ __ ] He always does. mostly to be fair to this young man. Um I I don't think he means to lie. I think he just doesn't know what the [ __ ] he's talking about. Um and uh you know and so he make and he makes stuff up. He just

he just makes stuff up on the fly. Um you know because it sounds plausible in his head. Um and it's just not true. Right. So, it's frustrating, but it's also frustrating a little bit uh in listening to Curtis sometimes when he's he has good moments and he has not so good moments, right? Uh we all do. Um

you know, the the point of how many visas we were talking about, etc. It could have been more crisp, a bit more clear. There are 20 million people entered the lottery. there are 120,000 um typically selected more in this year but around about that and 52,000 visas are available right it's a fairly easy

sequence of events to explain to the judge and the judge didn't understand that concept because Curtis didn't make it clear enough um so that was a bit frustrating um and there are other times when you know things have been sort of left to uh to you know just be left said and those things that are sometimes said

that are not counted are perhaps you know powerful. So for example the government lawyer said towards the end of the hearing um that as far as the government position is concerned the Ivangh plaintiffs are not part of the madani class. Um I think Curtis has order has argued that point in motions but it was still left said and not

argued uh not counted etc. So, you know, it's unfortunate, but that's the way it is, right? That doesn't mean that the government's lawyer is the person that decides that, but that was the opinion that was expressed in front of the judge, and that might that might uh resonate with the judge a little bit and

and that's unfortunate. So, you know, my um I I have various impressions. Now, on the positive side, once again, it's very clear to me that Judge Devida is very keen to uh to do what's fair and what's just within the powers that he has. Now, when Curtis was suggesting reserving 42,000 43,000 visas, um that seems like a too big an

ask to the judge. He doesn't believe he's got that power, authority, etc. Um and just as I had explained in previous um I think I've I've probably made this clear when I saw the motion um that uh that Red Eagle fi filed there were two parts of their argument. One was the um

the legal um argument trying to sort of discuss whether um uh whether visas could be reserved um and the the case law etc that was explaining that and how that could be done etc. Um and that was the leading argument in the in the motion in in the way I read it. Um the

second part of the motion or another part of the motion was about the sanctions. Um and pointing out that the court has the correct expectation that its orders should be followed and if the orders are not followed if there's contempt of the orders then they can there can be sanctions and sanctions uh

you know can be in you know delivered in various ways right. Um, in the in the hearing, we watched that play out. Exactly what I'd said. I I what I had said was that the sanctions argument is much stronger than the other argument. The other argument has been tried and tested and although it worked in the in

the 2020 uh cases to some extent, 2020 and 21, it eventually died in the appeal court. Right? But the sanctions argument is much stronger because you're reminding the court that they have the power and judge Dilla clearly uh understands that. Um and Judge Dilla was not happy that um that the government basically ignored his order for what he

assessed as 11 days. Right? So then he had done some mathematical calculations and decided that at the pace that he looked at there would be about 272 um visas issued per day if if they kept on that pace. Although it was good that he also looked at the uh the two last reports. The Friday report had 910 visas

issued and the Monday report had 610 I think it was. Um and so those are good high numbers. That's the level that we should have expected all the way through, right? And so, you know, you can take those days and they're two reports, but it accounts for a period of five days, right? Or four days if you

want to look at it that way because because it covers the weekend as well. Um, so, you know, the Monday report takes into account, you know, Monday business plus the Sunday in some uh in some areas. So that's why that 600 is a little bit lower. But the Friday report was Friday from Wednesday, right? So 900

in two days. Now uh the the number of visas issued in September 22 was about 14,000 and something. So that's 475 uh visas per day if you look at the calendar um for that month. Um and so frankly that's the sort of pace that I was hoping Curtis would come back with that. It is in his motions. He has

explained that in his motions. But I think once it was clear that the judge was looking at those 11 days, I would prefer we do 11 days times 475 than 11 times 272. Right. Um and so uh you know that it was a little unfortunate that Curtis wasn't able to make that point.

Um like I said, the point has been made in previous motions, but the judge is thinking about the current performance as being normal. The current performance is not normal. um it's substandard performance. Um and uh and you know from a from a couple of days we can see what they could have been performing like if

they had performed correctly during the whole time period from August 28th uh through to now right so we would have had thousands of visas issued um if they'd have kept up that performance at the proper pace if they had started off with uh correct instructions and and a cable that actually said get on with

work and if they hadn't have reapplied this uh the nonsense training standard and the new public charge things and we'd have had many more right um remember between the three three main groups there are more groups than this I know but there are three main groups there are 221g cases there are uh cases

that were cancelled uh for late August and and all of September um and then there are um people that never received uh two right the the cable and the government have largely ignored the the people that never received to announce they just haven't done those. They've done a very small number of the

rescheduled interviews. There were um 2,115 2,115 cancellations for September [clears throat] canceled interviews, which is about four and a half thousand people. And there were a few hundred people that we know must have been cancelled towards the end of August. So, I'm calling that 5,000 people. Cancelled interviews, 5,000 people. the 221g number. The government

told us that there were four over 14,000 uh people on 221g um uh many of whom most of whom were solely because of the two pauses. Right? So that we have the the the goal of 19,000 um from just two pots even ignoring that second uh that third pot of two and many

of you are not going to be happy with me that I'm talking about ignoring the two and else. I know, I understand your point of view, but I'm talking about, okay, you're not going to get everything. You're not going to get 43,000 visas. So, uh, how can you sort of focus on what they could have done if

they'd have done the job right? Um, and you know, I've said from the very beginning, the minute, uh, I heard the order, I said, "Here's what the priority is going to going to probably be." And lo and behold, that's what it said in the order. Uh, sorry, not in the order, in the cables. Um, and so, um, you know,

again, some of you don't like what I say. Um, but I'm right. So, um, all right. So, um, yeah, interesting hearing. Um, slightly frustrating for me. Um, it always is going to be a bit frustrating because it's very easy to criticize. Um, Monday morning quarterbacks is, you know, is what I'm doing there. That's um it's very easy to

criticize and think you'd have done a better job, but when you're actually on on the you know on the spot um you know it's harder to do. So let me take some um comments and see if I can answer some of these questions. Um say hi to folks in Nairobi, Kenya. Just did uh something good. I'm assuming we

shouldn't expect DV lottery 27 but accept 28. If so, when? Don't know. Um I I don't know. Uh, did it sound like the judge was going to include any guidance as to when the cable must go out? What about rescheduling interviews? >> Right. So, what's worrying to me is that the judge seems to be leaning towards a

continuation process. Um, he's he seems to be taking an 11-day period when the government clearly didn't comply. I would actually put that period longer because their compliance in the first few days after they started complying was not real compliance at all. Right. um you know approximately one visa, 24 visas, 50 visas, you know, it wasn't

real compliance. Um and there was massive confusion because of the government's uh disorganization and inept um behavior on the whole thing. So um but anyway, the judge is looking at 11 days. So he seems to be saying, look, as far as he's concerned, he has control over what his court ordered and he is

able to sanction the government. he I think he's leaning this way he's able to sanction the government to say okay you messed up for 11 days I'm going to tell you to extend that uh period for 11 days but then he went on to say but without metrics without a you know a goal in

mind so in other words uh we'll give you your um we'll give you the benefit of the doubt and and hope that you use good faith and he actually used that term good faith in operating the process as you have been for the last few days right? They won't do that. They clearly

won't do that. They're not going to turn around and do that. So, um unless there's metrics in there, it's going to be a toothless order. Um unfortunately, that does worry me. Um the government will be free to apply whatever public charge standard they feel like and just say, "Hey, judge, we we we saw all these

people and they were all a public charge. Who knew?" Um you know, uh they could do that. Um or they could just not schedule uh any cases or they could just you know uh just con I mean they could spend a week um thinking about how they're going to send the cable out to

uh to the embassies or just not do it and they could let the 11 days sort of like tick down into into nothing. Um so I'm I'm worried about the 11 days thing. The 11 days thing, you know, a continuence of this kind of worries me. Um, I I would be nervous of that. I'm not

quite sure. I would love to be proven wrong, but I would, you know, maybe the government will prove me wrong, but the government is going to resist very, very heavily at all sorts of levels in complying with this order. And so, the first thing they're going to do is lodge an appeal and they're going to ask for

an emergency stay. And it wouldn't surprise me at all. In fact, I I think it's almost certain that they would get um a stay on this, you know, possibly from Judge Devita himself and possibly as an emergency stay um through another court um uh through another judge perhaps. Um so, you know, it's that

wouldn't surprise me. Um and and during that time, we're burning the 11 days and the court may not see fit to carry on that 11 days to another period of time, right? And so it does worry me a little bit that whole sort of you know the basis on which um these sanctions or the

sanction could go forward is a little bit risky. Um you know I don't know um if the court reserves unused DV26 visas would already interviewed 221G AP cases like mine be eligible to use those reserve visas after September 30th? We have to wait and see. Right. Um the court must make this decision tomorrow,

tonight or tomorrow. Um for the order to be useful, it has to be published before September 30th ends. Right? Um if they don't do that, then you know then the answer is we don't has have a reservation, right? So um tomorrow we find out the details of this one way or the other whether we're going to get a

reservation or not. Um, I would say my my belief that we'll get a reservation has probably increased a little bit, but my fear about that reservation has increased also. Um, an 11-day order to me is going to be a problem. Um, you know, I have to say I also think that's the wrong math. Um, and it's not going

to satisfy everybody. Um, but it would give some chance to some people on 221G. Some of the the AP cases, you need to stop with the [ __ ] worrying about the AP cases. Honestly, AP cases are basically issued the A if you if you see the words administrative processing in SEAK. Your visa is printed out at the

embassy and you're going to get it in the next few days, right? So, will you please relax about AP? That isn't the problem. You guys are just like not listening and I I'm sorry I've got to be a bit blunt. I wish you would [ __ ] listen. This is the AP cases are printed

visas already. They were print authorized. This is carefully explained and I've carefully explained this in the uh in in the various lives. So those of you that are still worrying about AP are worrying needlessly. Now I know that some cases can be reversed from that. I fully understand that. I promise you. But that is not going to be the norm.

The AP cases are not the problem. Okay? That's a trivial point. And um those of you that thought that was going to be a big topic at the um at the hearing tonight are just losing the plot. You don't understand what's important. That's not an important point because you're going to be fine. Okay? So, stop

with the AP then. the 221G cases um that are still in 221G um you know and haven't been switched to AP those are more at risk right um and the 221G cases that were never reinvited for interview those people are at risk and those people could be could benefit from a continued uh effort and push by

the government um over an 11-day period. Um, but we've seen precious little rescheduling of the September and and August canceled um uh cases. That's not really okay with me. I'm I'm not ready to say, "Yeah, you can just forget about all of those." Um, doesn't doesn't wash doesn't wash well with me at all. Um,

and the two nails, okay, you know, I get it. the TLS were probably always a um a risky, you know, a risky thing, right? Um, I said from the very beginning when we got the order on on uh August 28th that the only embassies that I thought the only way we would get to NL's was

early on in very early September as I put it um and and possibly only at some of the embassies that have been quiet that hadn't done anything recently because they would have less work to do on the 221gs and the uh the rescheduling. Okay, so that's what I explained from the beginning. that you

know some of you didn't agree with me but that's you know that was the reality of it um and as time went on 2NL's uh getting new 2Nls is less and less likely and so new to LL's in the 11day period that's not going to happen forget about it right we'll be lucky to get a

reservation that would be a couple of thousand two or three thousand more uh visas that's probably what we're talking about here um if the government keeps up the pace that they've had over the last few days if they keep up that sort of pace Right. Um so you know that's that's the best we can hope for at the moment.

Remember we've had 2,000 visas issued because of the um the Madanian Ibangh orders. Right. Uh 2026 I think is the number. Um is it 2026? That's that's interesting. That's the same as the year. Let me just see my numbers. Oh, it is. Uh 2026. I didn't even realize that before. But yeah, 2026 is the uh is the

number of visas allegedly that have been approved, including those ones on AP. And don't get me started again about AP. Um but including those ones on AP, right? Um so we've had 2,000 issued if we or approved. Yeah. Okay. Approved. Um if we can get another couple of thousand on top of that, that would be, you know,

a pretty good win at this point. You get 4,000 visas where we were going to get none. that would be a pretty good win. It's not the win I wanted. Um, but you rarely get the win you want when you go into these lawsuits. It doesn't normally work that you get everything you ask

for. That's just not realistic. So, those of you that think, for example, all of the Ivangh cases, including those uh who didn't receive two, all of those should get their their um visas. I'm sorry, you're dreaming. Same thing for the plaintiffs and non-plaintiffs in the Madani case. to think that all of those

uh would be uh would be scheduled or would would get their visas. Again, it doesn't work like that. Okay. Um so, you know, this and and that should have been clear to any of you that participated in the lawsuit that participating in the lawsuit, just because you paid some money does not mean that you're

guaranteed to get um you know, what you think is fair treatment. That's not how it works. Um and that was frankly made clear to you by the lawyers and certainly by me. Um uh plea today please tell us about the four cases why embassy didn't call for the interview whose cases were updated

on September 24th. I don't know. Um I have no idea you know I don't know is the 11 days accepted. Um it's not accepted but that seems to be the way that the judge is leaning. Um he's doing that because he he controls his order and he controls the reaction to his order. He does not believe he does not

seem to believe Curtis's argument that he could reserve lots and lots of visas, 40,000 visas. He doesn't seem to believe that. But he does seem to believe regardless of what either lawyer says that he is entitled to expect compliance with his order and that he can fashion a remedy um to say to the government,

"Hey, you didn't comply for 11 days. Therefore, I'm going to tell you to do 11 days more work." and uh he doesn't like being told I can tell you that by you know by that young lawyer that um that he's not allowed to do that. So um you know whether he's got the guts to do

it or not I don't know but he should do right Simon uh I think you'll be going live soon. Could you please turn on the subtitles for us? Some of us don't understand English very well. You'll have to watch the the subtitles I think come to uh the videos after some time. Um, I don't have automated subtitles

live. Um, I don't think I don't know. You'd have to, you know, you'd have to watch the playback of the video, uh, and probably put it through, you know, um, some program or something. Um, wouldn't extending the fiscal year be highly illegal? Yes, but then not doing the job is highly illegal, right? Um, it's like

there are two wrongs here, right? And uh and so you know that's basically the sanctioned argument like you the government had didn't want to do something they wanted to stop playing the game and but they were told by the by the court that they had to do what the government had already said the uh

when I say the government what Congress has already said is the job is the task. they had a um a statutory duty to run this program and they haven't run it properly. And when the court told them to resume normal operations, they didn't resume normal operations. Um and they pissed around with this thing for days

and days and days. And then when they did start work, they did it in such an inept way um that it wasn't effective. It wasn't efficient. it wasn't uh it wasn't producing the numbers of visas that we saw are possible when we see saw on Friday 910 visas were issued between Wednesday and Friday. Well, why can't

you do that every every two days, right? 450 uh visas a day. Why can't you do that every day, right? So, um so yes, there's the problem of the fiscal year date, but there's also the problem of non-compliance with the court order. And so the judge has to weigh out those two uh those two things. Yes, the

uh the date is extremely important and the government are going to fight that tooth and nail. I promise you. Um but uh the the the courts in this country have a a lot of power and not even Trump understands that, right? Trump certainly doesn't understand that. He doesn't agree with it. Um and that's what we

mean when we talk about no kings. That's what we mean. Trump is not the king. Uh Congress set out the laws. Uh the courts can enforce the laws and hold people to account when they're not um working within the laws. And the government's job is administrative. The government, Trump's administration, is literally an

administrative function. It's not a kingship. Um and so, you know, um they're supposed to just do the job that Congress told them to do. What expectations can we have according to this? I had my case dismissed earlier today and Judge Walton specifically sent us to Red Eagle uh to fight in Madani. So this my case is is my last chance.

Yeah. So um I don't know your position Jack Frost. So you haven't told me what position you're in. Um and it's very difficult for me to say what's going to happen in your particular case. Right. So you can watch the Madani uh outcomes. We'll have the outcome tomorrow. uh we'll have some sort of order tomorrow

and if we don't get an order that in itself is is a decision, right? We have to have an order tomorrow otherwise it's meaningless. Okay. So yeah, you'll just have to wait and see what happens because of that. Will we get 11 days extra? Will we get some sort of numerical um uh order? I don't know.

We'll have to wait and see. We may get nothing. Uh the judge might weigh all of this up this evening and say actually I can't I can't do that. Okay. You know, there's no guarantee he's going to be able to do anything. I'm just hoping he will. Uh, Tokyo Embassy is holding a

passport since the 15th of September. No update till today. Okay. Judge Leon didn't ask for any hearing. He may order tomorrow. He may order tomorrow. You know, Judge Leon may order that, but if I had to state my life on it, I would not bet on on Judge Leon responding tomorrow, to be honest with you. Uh in

Peru we have 20 cases that did not pass the second interview as well as cases that were cancelled even though they had already been scheduled for the first interview. Yeah. Okay. Um uh no reason to believe that they will have DV28. Yeah. Uh thank you for the updates. What was said about the

performance in AFMC's? Anything about those who are not scheduling reins? They talked about that briefly. Um Curtis had previously raised the point that um the compliance by the European embassies was far higher than the compliance in any African embassy for example. Um and uh and the government lawyer said that it was impossible to get that data. I could

get that data in a heartbeat. Like if they just gave me the access to the seak database, um I could get that data. If they would give Zarissius the the access to the database that we've had, we could get that data in a heartbeat, right? We can tell which embassy the cases are are

at. Um we can tell the status reports, etc. of what changed. Um or rather we could up until December of last year, we could tell all that. But we can't now. We don't have that data now. uh they've deliberately and effectively blinded us in terms of SEAK data. So we don't have that information now. But if they would

give us that back, yeah, we could we could do it. So it's, you know, um the government lawyer who doesn't know his his [ __ ] at all uh said that that would be a difficult manual exercise, manual reconciliation. No, it wouldn't. It would take me 10 minutes, five minutes. Um you know, so ridiculous. But he

doesn't know what the hell he's talking about. He really doesn't know what he's talking about. Um, I felt like the clarification about Ivanov plaintiffs by Curtis did not help them. It wasn't uh Curtis. Some of you misunderstand who was talking. Ivangh um the position on Ivangh plaintiffs was by the government lawyer. That's the government lawyer's

position, not Curtis's position. Um Curtis's position on this is that Ivanov plaintiffs are a part of the class and the government is now saying that they're not part of the class. It's up to the judge to say whether they're part of the class or not. And he may or may not include that in his order. I don't

know. Uh why don't Curtis argue perjury is all we know that Chur is lying. That's just not even a thing, right? Um it's not perjury to be an idiot. Uh if you don't know what the [ __ ] you're talking about and you say something, that's not perjury. Um that's stupidity. And and unfortunately in this country,

we can't put people in prison because they're stupid because if we could, 30% of this country would be in prison straight away. All the ones that voted for Trump. Um but he can't do that. So stop dreaming. Uh last day here in Sydney and still stuck on AP since 23rd September. You're fine. If you're on AP,

you're fine. Just [ __ ] relax. H you don't need to to benefit from the reservation visa. You're fine. Your visa is printed. Those of you that are on administrative processing have had your visas printed already. Please try and understand this. Just by the way you began, I knew it was bad. [laughter]

In Montreal, they didn't ask plaintiffs for rein who are on 22G not related to the PS. Yeah. Um they Yeah. Not every embassy. There's there's sad stories coming out from many many embassies. Not very many um have done well. KDU, Catmandu I think has been a high point. I think London has been a high point.

Warsaw to an extent has been a high high point. Vienna got in the game today. There are a number of embassies that got in the game today uh and issued visas for the first time. Um uh but generally speaking generally um most embassies there's sad cases to talk about and and you know there sad cases

for anyone who is waiting for a 2 and uh there sad cases for many people who who had um canceled interviews many of whom had already um had their medicals performed and so on when their uh appointments were canceled. Some of those people turned up to the embassy for their appointment dates and were

sent away from the embassy on that date. I mean, there's some sad stories around, right? Um, and so, yeah, you don't need to keep telling me. I know. I know all the all the stories. Um, wasn't there a point for the plaintiffs on how Ivanov is not part of the class, but government

calculates reports based on applicants, including Ivanov? Yeah, that was probably that point that could have been made. Um, Curtis didn't make it, but okay. Every time there's a live stream outside of Saturdays, I know the government have done something stupid again. Yeah. It's just like if they wake up in the morning, they're going to do

something stupid. What's the story of 11 days? The story is the time period when the government did nothing before um Judge Diva had to step in and order uh you know some sort of enforcement. Um and so uh you know that's the 11-day period he's talking about. Simon, could the DV26 fiscal year be

extended or could unprocessed DV26 selectes be allowed to use their selection for DV27 because of the delays caused by the pauses? Um, [sighs] I would normally just like ignore this question because I've discussed it so many times, but you're raising a slightly commonly asked question. So, let me ask let me answer that. Um

firstly the question about whether it could be extended or not. That's exactly what the court hearing was discussing. Right? And that's and the 11 days that we're talking about is the court suggesting um that maybe they can as a sanction to the government for the non-compliance against the order. They would take the

11 days when the government did nothing apart from organize some emails and uh and and and talk about how the cable should look. when they did nothing. Uh the the court is thinking the judge is thinking that he can take that 11 days and force them to work another 11 days, right? Um whether that will happen or

not, we don't know. Um could DB26 selectees be allowed to use their selection for DB27? Well, it's not really as simple as that. Frankly, if if they can start juggling people around like that, then they can do anything. if they can ignore the laws that we already have, then they can do anything, right? And so we're in a we're

in a difficult place when we start creating um creative solutions. Um and you know, we'll have to do some sort of creative solution like the 11 days is a creative solution, but just saying, "Hey, we'll give you the DB26 uh the 26 people that are missing out. We'll give you the 20 DB27 uh visas because they haven't been

made." Well, no, because that's not how the law works. And two, I want them to do DV27 even in a shorter form. I don't think they should be allowed to just get away with throwing away another 55,000 visas, right? It's bad enough they're going to throw away 40,000 in this year. Like, we're just going to just like

forget that and and and ignore DV27 and pretend that that didn't have to happen. No, I'm I'm not ready to give up on that. Um, I want Curtis to continue to fight on that. I want the government to do what they're supposed to do and I don't care that their regulations are being broken by this. I would rather

look at the law rather than their regulations. Um, so, you know, uh, Curtis kind of scored an own goal by bringing the inclusion of the Ivanov plaintiffs in such a weak wording. Um, I I I don't think so. The topic needed to be raised. Um, uh, you know, and it's in the motions.

Um but he was probing I think and testing. So you know um at least he got on record how the government sees it. I think maybe uh it could have been stronger worded but you know you can't I would have a tough time in a court hearing because I'm an [ __ ] right?

Um and you know it takes it takes a very very wise very highly intelligent uh very good competent arguer uh to really do these things well to be firm and um and be um aggressive without being offensive right and I would I personally I would probably drift into the offensive um and that would be a problem

in in most courts right that's probably why uh I probably wouldn't make a good lawyer right Curtis I believe is probably not quite as sharp as I would like him to be and not quite as aggressive as I would like him to be. If you've ever heard Charles Cook um argue a case, uh you'll know what I mean.

Charles Cook is uh you know is is, you know, more senior uh more rounded, you know, better arguer. Um Jesse Bless, another one, you know, I would put money on those guys all day long to to argue cases. Um Curtis is good and he's a great bulldog. Um but he's not quite as

good and I think he recognizes this. He's not quite as good in those live court hearing situations as he is on maintaining the effort. But bearing in mind Curtis is uh by and large probably one of the main reasons that we're even in this position. So, um, far be it from me to criticize Curtis in any way, um,

uh, you know, for what I might see as, uh, as, you know, shortfalls or whatever. You know, he, we wouldn't have a conversation if it wasn't for Curtis. This, look at what Judge Leon has done. Nothing, right? In terms of enforce enforcement, nothing. And that's that's with a very fine set of lawyers from two

law firms, Red Eagle and Impact, and a great legal team who achieved a great win on August 25th, right? But what has Judge Leon done in terms of enforcement? Nothing. What did Curtis do when in Madani um there was no uh there was no, you know, sort of anything happening. he as well as the impact team they went

back to enforcement in in Judge Leyon's case that got nowhere because of judge Leyon not because of the you know bad work on part of the impact or red eagle team it's just judge Leon decided to do nothing about it judge Dilla on the other hand um started to require these reports every two days and that's

massive right so uh and Curtis achieved that so you know um we also we wouldn't be in uh California court if it weren't for Curtis. That was a a wise move, I think, to move at least one of the cases out from DC. Um and again, we wouldn't be in this position. We we'd have been

if we'd have filed uh the Red Eagle number two case, the the Madani case in DC and that would have gone to Judge Leon and it would have died there, same as all the rest of Judge Leon's case, right? That's where we would be. So again, wise decision by Curtis on on moving it out of DC. So, um, you know,

so yeah, there's going to be a lot of you bitching and moaning, I'm sure, about about, you know, you could have done better. And and as I say, forgive me if I sound um uh um arrogant about about my arguing ability or my knowledge of this program. Uh I don't mean to be like that. just

it's a personal frustration but I highly respect frankly high highly respect all of the lawyers that I work with uh you know Curtis and Dean Garrett Chuck Bo rea um you know all of them they do a great job on the red eagle team the impact team love them to death uh you

know Greg Jesse um and Charles of course um uh you know they're exceptional lawyers you can't find better you literally can't find better so um you know Um don't think don't don't misunderstand my comments please. Uh 11 days during weekends it wasn't clarified. Um uh they didn't specify. Um I've lost plenty from Nepal. Completed

my rein on September 18th. Uh status changed already after a fuse date is daily updated but status didn't change. Why is it so? I don't know. Very frustrated. Simon did rein on September 18th. Uh it's the same same question, same person. It seems those who are placed under 221G and interviewed before the DV pause have not been reviewed at

all and are still pending. Yeah, I'm not quite sure I understand that, but okay. Uh what happens to me, Madani plaintiff? No tol or I forget DV26. You're probably not going to um you're probably not going to benefit from uh DV26 is the honest answer. Um, I don't expect any more TLS to be set out sent out. And if

the reservation is only for 11 days, um, it definitely won't happen, right? So, you know, that's how it will end for you, I'm afraid. Uh, good evening, Simon. What if the embassy AIT in uh, Taiwan uh, keep not updating the status? We already have the 221g. Um, so I'm hoping that uh hopefully you're chasing

I'm I'm worried about those cases that went for reinter where you did go for rein and the and the uh but it was probably before the 21st of this month. Um because before the 21st of this month the government were not clear were not um they they did not understand how to operate this

process. Let me show you something. Um, I think I've explained this already, but um, share screen. Here's what I'm talking about. Hopefully, it'll come up. Yeah. So, this is the daily reports that we started getting on the 14th, right? Um, so this was Monday the 14th, this was Wednesday, this was Friday the 18th, and then we

had uh the 21st, 23rd, and 25th in the second week. Um so it's reports on the Monday, Wednesday and Friday for a couple of weeks plus a little bit more. Right? In the first week uh famously their first report said they had approved approximately one um case and they refused 169. And we're like okay

that's kind of a weird uh number there but uh you know there's a huge disparity between the refusals and the one that you've approved right. and then 218 refusals uh the next report and 28 approved. Still not really working right. Like what's going on? 51 um the next day by the 18th. This is a a week

after the enforcement order, right? And they're they're refusing 298. Well, what was going on is that some people were being refused 221g that were really approved by the um by the co, right? But the CEO had not been given good instructions up to that point on what they were supposed to do. Right? And so

that that continued and that continued on up until the report of the 21st as well, which looks back the report on the 21st looks back to the previous time before the Friday report, right? Um and so that continued. Then on the 21st of the month, the government sent out an email to all the embassies explaining

what they're supposed to do. And they said that you should put these cases, if you're happy with the case and you want to approve it, you need to um do print authorized. And print authorized puts cases into administrative processing. That's the status that you see in um in SE. So the cases before the 21st, all of

these refusals, or not all of the refusals, but a large number of those refusals, which is 752 cases, a lot of those cases were actual approvals that were put into 221g refusal status, right? And many of those have now been corrected, but not all of them will have been corrected. So, if you're still in

that position and it's the final day now because you know it's the 30th of September in some countries around the world um you need to be chasing your embassy today and saying hey you're trying to approve me but the but if you read your email from 21st of um uh of this month and if you read this uh

paragraph 8 or section 8 from the from the report and I've published this information so you know you should have this information to hand it was in the uh status report of the 21st uh which let me find it because some of you are going to say I don't have that. Um the

one this is go back. Why have I not got all of my reports open? Oh wow. Where have they all gone? Um I'm not sure what the what the number is. It's not one. It's not 130. It's not 129. 130 is the report from um from 928. So yes, it's before that. I

think it was it was um filing number 115. Uh but where can I get one? Hang on one second. Sorry, let me just find this because I know some of you are going to want to have this. Um okay, demos. Uh 115 on yeah 9:21 DFS notice status report. Here we go. Okay. So um

this is it's document number 112. Um and it's the status report filed on 921. Um and in that status report, no not in that document. Sorry. I think it's the next one. DFS notice. What's that? No, not that fuse. Madani P 108. No.

Oh, that's annoying. I thought it was in there and I had it open and somehow it's closed. That's really annoying. If somebody has the document number, please ping me in the chat there. I I've got all the documents downloaded, but I but I'm not quite sure which one it is and can't pull it up at the moment. But

anyway, there's section 18 is what I'm talking about. It's the declaration from I think it's John Armstrong. Um that's what I'm talking about. And in that declaration, um there's a clear description of how the um of how the the embassies are supposed to behave and also confirmation that on that day they were emailed um explaining how they were

supposed to be behaving, right? And that was the important point. That's what then changed the behavior from one day to the next. Um and we started to see decent performance, right? we saw a massive reduction in the number of um refusals and a big increase in the number of issuances. That's because of

the email and the instruction that came out that we got to know about in that declaration by Armstrong. Um and so uh so yeah, that's that's the bit that you need to refer to. Now, you've got a few hours left. You need to go find that um uh that document if you're in the

Telegram channels. I'm sure it's already in there. Um, and if I can get that before the end of this uh live stream, I'll try and uh tell you exactly which document to look in. Um, and get that. Um, it is 115. Uh, it is Madani 15. 115. I thought it was 115. I had that, didn't I?

Uh, yeah, I had it. DFS notice. I just didn't scroll down enough. Maybe. I don't know. Let's have a look. The answer on declaration. I'm sorry, it's there. How was I missing that? Uh, section. Sorry, exception nine. This is the section we're talking about, right? Uh the email noted that if a consular

officer determines that an applicant is eligible, the case must be print authorized and the consular manager must complete an adjudication review. Once that review is complete, blah blah blah. The point is that some of the embassies don't understand this instruction. Curtis has made a comment about that today. Um but it's very clear, it's been

clear for a number of days that some of them don't understand this instruction. And so, um, it would be, um, it would be important if you're in a 221G situation, and I'm not talking about administrative processing cases. Don't get me started again, you're fine. Um, what I'm talking about is the people that are in a 221g

refusal situation, but you believe you were appro approved during the um during the interview, the rein, right? And those cases need a nudge. And so the nudge is you contact the embassy and you screenshot this document. It's the case. It's the 115 document from the um uh from the lawsuit. Um I'll make it

available in te telegram channels. I'll put it on my blog later just so that you've got it uh within an hour or something. I'll get it onto the the blog. Um and you can screenshot this particular thing and send that to the embassies and say, "Hey, you muppets, that's what you're supposed to be doing,

right? you're leaving me in 221G status and actually what you're supposed to do is press the print authorize button and that will move you into uh administrative processing which means that the printer prints out the visa and that as long as that happens as long as you moved into that status before midnight on September 30th you're safe.

Okay. So, if the if the console officer wants to approve your case but doesn't know how to, which is a possibility, then this is an explanation of how uh they're supposed to do that. Okay. Um All right. So, hope that's clear. Um okay, where am I at? Um let's see if I got some more interesting questions. If

not, I'll post that stuff. Okay. So, um I think we need to cut Curtis some slack. Absolutely. Uh he has fought for this this whole time. He's among the few who decided to take this. Absolutely 100% agree. Uh nothing but praise for what he's done. I'm certainly not going to criticize him. I'm not, you know, no way in the

world I'm going to criticize him for the energy and for the effort and uh and the and the caring he's put into these cases. Some of some of you I I do get frustrated when some of you um I read something today. I responded to someone on Reddit um today because um you know they're talking about the uh

the reservation thing is just a money grab by the lawyers. That's absolutely like you're you're bent in the head. You're not right when you say things like that. It's because you've got personal access to grinded. you got upset from what happened a few years ago or whatever and you somehow twisted you walked thei situation. Um the reality is

that um I explained in in my response on Reddit today that there are two situations. The impact team charged a low fee with no backend um fee. Um and uh and so they have no financial incentive. If if Judge Leon by some miracle woke up tomorrow and gave a um and gave some sort of uh

order to say, "Yeah, they're going to preserve visas." The impact team don't have a fee arrangement to pay for the inevitable appeal process that that would bring in, right? And so, um, if it went into an appeals process, impact would need to find some way of funding that, which would probably mean people

have got to pay some sort of additional fee, right? Red Eagle, on the other hand, have already got a contingency built into their fee. They charged a low amount of money up front with a fee payable after you enter into the USA. So, they have a a high um financial incentive to see more people get

through, right? So, if they can get another hundred cases through, 100 times $2,000 is worth earning, right? That would finance uh the appeals process and everything else. Um, if they can if they can win that and it becomes a sort of a no- win, no fee type arrangement at that point. If he doesn't get you your visa,

you don't pay him that $2,000. So, his fee structure was very clever and actually um works out for you very well because you don't have to agree to pay more money. Um I don't think I can't speak for Curtis, but I don't think he's going to ask for that because he's already incentivized by his fee

structure to get more of you into into getting your visas. So, um, uh, you know, so, so to talk about this whole argument as being a money grab is to not understand what the [ __ ] you're talking about. To be perfectly honest, is you, you, you haven't used the smartle particles and

applied some critical thinking to figure out, well, how are they trying to get more money? They're not trying to get more money. They're simply, you know, you can understand they're not going to work for nothing. But at the same time, Curtis in particular, Red Eagle have a financial incentive to try and get more

of you your your visas, and that's what he's trying to do, right? Um, so yeah, so it does frustrate me when some of you um make silly comments and and you know uh you know that that guy, what's his I can't remember his name, but the save diversity visa guy is has got a constant pissed-off attitude. He's

had it for years because he didn't get his visa um in the 2020 cases. He's constantly angry and constantly at uh you know complaining about the lawyers because they do uh they they do try and fight for people and and this this guy just won't let it go because he's just a pain in everyone's ass. So um you know

um it's unfortunate but some people get stuck in that. They the the stages of grief that I've talked about before. Some people get stuck in the anger phase and they can never let it go. And it it frankly probably just eats them up inside. But, you know, that's their problem. Uh, if the DV27 program does

end up opening, what do you think it might look like? I don't know. Can we talk about that some other day when we're not talking about DV26? Simon, uh, you were right. I need to relax. I just recently got issued in Sydney. There you go. Um, thank you so much for your help during this difficult

time. Uh, always watch your v videos for guidance. I can't thank you enough. You're very welcome. I'm glad to be proven right on that point. >> [laughter] >> Uh, hey Simon, how are you? I'm just wondering about the CX data showing issued. Does it mean the visa is already printed on the passport or it just shows

on the system only? Do they give the visa or not? So, a little bit of um reading between the lines on this. Um, if we look at that, um, let me let me go back to the to that section nine. This is section nine, not section eight. Let me just read the rest of this to you. Um

I read read before but it says once that review is complete the consular manager must submit the case for additional adjudication review which must be completed through submission via an app established for this purpose. They've created an app. Once the consular officer receives a response through the app, the officer will receive a report

to review and we'll assess whether additional action is needed including any action to spoil the visa. Spoil the foil or spoil the visa. that means tear up the visa that they've printed. Um or if the visa has been printed and issued whether revocation is appropriate. Now um h how the embassies have interpreted

that is they're not sure what the government the DC app is going to do. They've never had this before. This is a new app and they're not really used to it. The console officers are used to making their own decision and that decision being theirs. Now, we've got this app being involved in their

process, and they don't know how to work it out, but they're but they've been read the riot act and they've been told that they are responsible for their uh reports that they have to submit through this dopey app or whatever. And so, they're nervous, right? So, what have they done? They've held on to those

cases. They've held on to those visas in a lot of cases. Some people have received printed visas from some uh embassies, but in the LA in the main people have uh have not received their visas. They've been looking at administrative processing status for a long time. And maybe it switches to issued today, maybe it doesn't. Does

doesn't really matter. Point is that it's already been uh printed. And so what the embassy is doing is just in case they get this sort of uh refusal thing or this problem from the app, they don't know what to expect. just in case of that they're holding on to the visas right so once we get past the deadline

those visas can then be sent out and will be sent out that's why uh you know I'm slightly harsh with those people who are whining about the administrative processing because I've understood what this means right um and and what I'm saying is coming true for people so you know um so that is happening and you'll

see it happening more in the next uh 12 to 24 hours right so um Now last point about this this thing um uh if the visa has been printed and issued whether revocation is appropriate. Now this is a scary thing. This app in DC has some sort of algorithm or some sort of human

invol involvement to search for cases that are somehow not fully justified. We don't know what what criteria they're using, what process they're using. We we don't know, right? and the app in DC sends a message back to the conser officer and says, "Hey, that's a problem. You better tear up the visa if

you if you've printed it, but you still get a hold of it, or you better revoke the visa if it's been printed and issued." And so, somebody today has reported that their visa was printed and issued, I think, from Cairo. I'm not quite sure about that, but um it was physically in their hands and then the

embassy contacted them and revoked the visa. Okay. Now that puts that person in a very very difficult position. Um I don't know the details of why it was revoked you know don't know anything about that but it was revoked and it would have been revoked based on this um it whether revocation is appropriate

right we don't know what that means other than it has happened in at least one case and so it could happen to other cases I don't think it'll be very widespread but um that's why this administrative processing period I've I've said to people that's 99% % safe, right? I used to say it was 99.99%

safe because in the whole time that Zarissius and I have been dealing with the with that new status, which has been about three years or so, I think we've seen about four or five cases go from administrative processing to refused where there was some sort of problem. So, we knew it we knew it was

technically possible to see those refusals, but it was exceedingly rare. Um and so um however right now we know that that's going to be less rare because of this stupid app and we don't quite know what that um will do and when that will kick in etc. And so some cases maybe some more cases will be affected

in that way which will be heartbreaking if that happens. But you know bearing in mind my theory is about saving as many starfish as possible. I I can't get too um impacted by, you know, one dead star starfish. I have to look at the ones I can save, right? Um so um you know, not

that it doesn't hurt me. It does. Every single one of them hurts, frankly. Probably more than you understand. But um uh but you know, that's all I can do is just work for the most starfish possible, right? So that's what I do. I hope you understand that analogy. Um, okay. What about the TV selectes whose

interviews were canceled or postponed, still have not been given a new interview date? They're uh out of luck and they're probably not going to be fixed. Um, if we get an 11-day reservation, there might be some of those um cancelled and postponed. Maybe they'll arrange some of those, but it's not that likely to be honest with you.

um the workload that was impacted onto the embassies from the 221G cases and the reinterviews and the higher um the higher amount of work that is now forced onto the consular offices and the embassies because of this new process is more than they ever expected and that has overwhelmed the embassies and it

should have been clear to the government that it was going to do that and frankly maybe that's what they were deliberately trying to do um because it's just another way to slow people down and This is kind of the problem I had with what the judge is trying to weigh up here. The 2026 visas that we've had approved

is a poor number. That's a low number. It should have been far higher than that. Um and so to sort of say that they should keep up that pace, it's kind of missing the point. They should have been going faster than that. So um if the court gives an order to reserve visas, will that apply to plaintiffs

only? I gave my interview in June 11th and said visa falls under then got no interview, no phone calls. This was touched on slightly in the hearing this afternoon. Um Curtis pointed out that as class members, non-plaintists were very rarely helped by uh by the court's order. Um mostly there was um uh there was

preference given to the uh to the plaintiffs both in Ivangh and in Madani. Now I think this is an area where if I'd have been arguing I probably would have been a little bit more forceful about that point because um there's no part of the Madani order that said that gives any priority to plaintiffs. There is

also no plan part of the Ivangh order that says uh that plaintiffs in that case have priority over any other case. There's nothing like that. Right. However, the government chose to give plaintiffs in the Ivangh case, which I can understand because they're the only people, but also plaintiffs in the Madani case, um, chose to give them, um,

some sort of elevated uh, priority, um, which the government just made up by themselves, right? So, Judge Devida should have been made more aware of that unfairness in a sense. Um, and Curtis did go into it a little bit, um, saying that they were extremely rare, that the class members had really not had the

benefit of the order. Um, and he's right to point that out, and it's true. Um, it's just very difficult to point it out with with numbers, but we know it's true, right? We just don't have the actual hard data because we can't get the data now, but we do know that that's the case, right? So um

so yeah that's uh so that's that's that was the discussion. Now what that means is if we had this 11 days or if we had any sort of reservation it would not apply only to plaintiffs. It would apply to everybody but there is an obvious priority that is happening to plaintiffs. And so you know plaintiffs

um you know tend to have more chance. If you're a non-plaintiff you don't have as much chance. That should have been clear to everyone from the beginning as well. We had discussed that by the way months ago. I mean I I think I've made that clear over the over the time. What I

said was if you can afford to be a plaintiff, if you can afford to be on the lawsuit, you should do so. Um don't expect that non-plaintiffs will have the same rights as the plaintiffs, right? Um I said on the other hand, if you can't afford to do that, then as a non-plaintiff, you may well get some

sort of benefit. Um and you know and that has turned out to be true for some people but not as many people as uh as we would have liked. Okay. So haven't got a call from now till my MC or my doc documents already. This seems so unfair. Yeah. Um have the redacted parts of the cable

been unredacted? I don't know. Um present guidance again a vast majority of African embassies. I I disagree. Um uh I I think that's a conspiracy theory. Um there is not going to be a cable that says, "Hey, don't give um visas to people in Africa." There is there isn't a cable that says that. Um there is um

there's a travel ban which impacts many of the people in Africa. About half the people in Africa are impacted by the travel ban. Right? That's a big problem. Um there's also a a typical uh slowness in the embassies in Africa for whatever reason, right? Um and there is also some numerical differences in

the embassies in Africa. The the derivative rate for example in Africa compared to Europe is massively different, right? Uh it's about 1.6 versus 2.25. And so that what that means is that when you schedule a thousand cases from Europe and a thousand cases from Africa, there's a big difference in the number of people you're talking

about. Then there's a big difference in the number of people that turn up for their interviews. It's less in Africa and you've got more refusals in Africa. And during these public charge days, you've got more refusals because of that in Africa, right? And so there are there are various factors which means it's

harder to um to get to the same number of visas issued in Africa and frankly they almost didn't try um you know it's pretty clear that many of the embassies didn't do enough um because it's kind of an uphill battle. I'm not trying to justify it at all but I am trying to

explain uh for understanding rather than justification. Um you know um okay lot of repeated active R subjectivos uh our case was placed under 221G before DB pause. Um yeah so we'll have to wait and see about whether that could be rescheduled during the uh the 11 days if that's what we get. But let's let's get the order

first. Right. Um, I think I've covered the the I'm scrolling through some questions. I'm reading them quickly. Um, and I think I'm covering most of those things. Um, which report and section we can refer when men in the embassy stating they've not followed the or the as orders. Right. So, it's it it's the 115 is the

um is the document number. You can go on peser and download it from there. Um or court listener. Um let me get let me see if I can get the court listener trunk. Yeah, it's uh 115. Let me see. Is it Oh, you have to buy it on PO. Uh someone got a

link for me. If somebody could put a link to that in public, that would be handy. But anyway, it's section nine. It's what I was showing. Um, you could take it from a screenshot what I was showing just a moment ago if you wanted to. So, hang on a second. Let me take

that off. Let me do that. If you screenshot this section here, that's what you're trying to get. Right. So, let me make that a little bit bigger and move this across. Okay, there you go. Right, screenshot that. Um, pause and screenshot that, right? That's what you have to send. Um, it's in the uh the

document is 115. The document number is 115 from the Madani uh case and it's uh titled the DFS notice. PDF. Okay, that's it. All right. So, um it would also be great if we had the email. I'm not sure if the email is in another document or not, but um but clearly that's the clear instruction.

That's what we need to do. Um Montreal started sending out issued cases today. Good. Um hope that continues tomorrow. Any opinion about public charge? Why doesn't the government just um just out punishment for immigrants who break the rules on while in the US instead of just deny them the chance? This whole thing is

stupid. people who are immigrants to this country are not entitled to the type of public charge benefits that they're saying they've claimed. So you you don't get them. Frankly, this whole thing is a complete nonsense. Um the justification for the public charge thing was a nonsense. The the justification for all this new public

charge um processing is a nonsense. The whole thing is [ __ ] Um it's it's pretextual. It's designed to stop immigration or reduce immigration. It's just a pretext. So, don't try and argue with the pretext because the pretext is [ __ ] right? It's what it is. They're just making it up. It's nonsense. Um, yeah.

Hi, Simon. I'm in Thailand. I love the way people spell my name like that. Simon. Uh, I'm in Thailand. I received 221A refusal. That's public charge. But the US Embassy asked me to submit additional supporting documents and my passport for further processing. I hope you did that. Um, so they they're holding out an olive branch to you.

Right. The 212 A4 refusal can be overcome if you've got additional evidence. I'm pissed off with you that you went to an interview uh during these last few weeks without all of the evidence when you've got more evidence that you could have provided. Right? if you're now able to provide that evidence. However, I'll let that go for

a minute and and uh and say yes, if you have complied with their request and you've given them additional supporting uh documents and your passport, then there's a chance that you could get um issued uh you know with your visa, but it's got to be done by midnight on the 30th of September tomorrow. Tomorrow my

time, probably today your time already. Okay. So, you got virtually no time. So, I hope you've already done that. Okay. Can a visa be issued without a passport? Because consular officers are not willing to keep our passport at the time of re-enter. Yes, it can. They can print the visa without the physical passport

in the same room, right? Um the the visa is a printed visa which is then glued fixed into the passport onto a a clean page. So, as long as they've printed the visa, that can sit in a drawer or something or a filing cabinet waiting for you to give them the passport, right? So, that's okay. That's not a

problem. And that that all uh you know that fixing it into your passport, that can happen after the 30th of September. So, it is possible. Now, although it's possible, that doesn't mean they will do it in every case, right? Uh some of them will do it, some of them won't. Um hopefully they will for you. I fingers

crossed for you. If Trump camp doesn't win the 2028 elections and Blues do, will everything go back to the way it was or will the new rules on public office remain? I don't know. Um I I don't know is my answer to that. We'll have to wait and see. That's a long way

off, right? Um is it normal after approval rein CC refused previous to interview then administrative process but totally changed again already. So when you see it's gone to administrative processing, that's a good sign they've tried to print the the visa. It's possible that it might switch back to ready after that and hopefully it goes

from ready and then might go back to AP or even to issued. Um there's something going on. But exactly what's going on with your case? Obviously, I don't know exactly. Right. So yeah. Uh oh, you're in the States. Well done. Glad to hear that. Um, isn't the hearing going on now? It's finished now. I just

thought I'd jump online and explain what I heard is happening. I'm sure other people have got different opinions, too. Uh, God bless you. We are interviewed in Algeria. We took our passports, but K still under 221G refusal. We're Ivan off plenty. I sent an email with section 09, but no response. Yeah, that's what you

have to do. And I hope that gets sorted out today. Um, you know, today your time. I mean, September 30th. Fingers crossed for you. You've done the best you can do. That's all you can do, right? Are they able to issue new case numbers and extend them after September 30th? No. Again, that's just them making

up. If they were able to say, "Here's 10,000 people that won DV26. We'll make them the winners of DV27." If they can do that, then it makes a mockery of the whole rule set that says there should be a draw process, a randomized draw and everything else. If they can if they can

fix it like that, that just means the whole process is a is a is a a scam, right? And so they have to follow some of the rules. Um, and we have to hold them to those rules, right? But there is a difference between their procedures and policies and regulations and the law. The law trumps all of that crap.

And and I'm asking to hold them to the law and what you're suggesting there would be breaking the law, which is why I'm not in favor of that. Um, but I am in favor of them breaking their regulations like having a 30-day entry period or, you know, um, all of these other things that they've made up. Right

now, there is one law that I think they need to deal with, and it's the reservation, um, thing, the 30th of September, uh, deadline. That's a law. That's not a regulation. And so, that's a big deal. I understand what I'm what I'm suggesting there. Um, that is a big deal, but that's the only way out of

this problem, right? and and mainly because of sanctions for the non-compliance and contempt the government have shown in the way they've operated. According to timeline time, today is September 30th. My documents and passport are expected to arrive arrive at the embassy today. Wow. But I don't know if there's enough time for them to

take any action before. Yeah, contact them and say that right that the passport is expected to be there today. Can they print the the um uh the um the visa uh without having the passport? Or maybe you think the passport will be there, I don't know, by midm morning or whatever. Um tell them what's happening,

communicate with them, advocate for yourself. Okay. Uh doesn't the DC decision reversing issue visas contradict consular non-reviewability that was discussed in the hearing today? Yes, it does. It makes a mockery of it. Um and future lawsuits, I'm sure, will be referring to this evidence that we've gathered here. Um things like section 9

in this declaration by John Armstrong is an absolute smoking gun for us. um that you know um the officer will receive a report to review and will assess. It does say the officer will assess whether additional action is needed including any action to spoil the visa or if the visa has been printed and issued whether revocation is

appropriate. But that came from the app, right? Who's the app? What's the app? The app isn't the consular officer. So yeah, that is it. It does pierce this defense that they've relied on for many years about consular and non-reability. Um, they've shot themselves in the foot, frankly. But they're stupid. That's why they did that. Can you imagine a

president that has multiple bankruptcies, billions, and spent the war machine, which he promised not to, fearing that some immigrants might get benefits? Yeah, ridiculous. uh regarding the I134 can we can we fill it as self-s support in case we cannot find the support in the US to to my way of thinking it doesn't make

sense to do that the I134 is a spons is a a form that a sponsor in the US a US taxpayer can pay and that person is already in the US and has an income that is uh US style and size of income and um is someone that you know the government can background check or whatever us,

right? You filling out the I134 for yourself doesn't make a lot of sense is just the same as you saying what listing out what your assets are and what your um uh you know what your savings are and your income and everything else. You could do that just as well without the I134. I do believe that some embassies

have asked people to fill out the I134 for themselves, but it's kind of a stupid use of the form to be honest with you. It doesn't make sense. Um, once upon a time I thought that was a good idea. I was actually planning to do that for my own case back in 2014 when I was planning to do consular

processings before I did adjustment of status. And I argued with um someone's mom um someone's mom is another DB lottery expert that I've known for years. Um, I argued with her, she thought that was a bad idea and I argued that it was a good idea to do my own financial statement in

the I134 as it existed at that time because it was an organized way of putting the information. I now think I was wrong at that time. Um, I think she was right. I think it's kind of a stupid use of the form, but I know some embassies are asking for it. So, you

know, do do what you want. Uh, for some of us, C has not changed since interview in June since the pause. Still refused under 221G. What's your take on that, Simon? Um, I'm afraid you're not going to um we're not going to have a Manchester United Ugandan foot soldier. Um, uh, I'm afraid that's what that

means. Your your journey is probably going to end tomorrow. Uh, got to interview in April. No past documentation to um, what now, Simon? Yeah, I think I've answered that one already. I think I've answered all the questions. Uh, done that one, I think. Yeah. Um, yeah, I think I've answered all the questions, but um, we'll have a quick

moment if there's anything else. Uh if a re-in 221g was conducted on last Thursday with a positive result approved change from refused to ready then admin processing and today cak is on ready again. Is it an error of the page? Yeah, I think I answered that one Katherine. I I I would say that you've got a good

chance there's probably something good going on. It could be something bad as well. It could be that you were put into administrative processing but the DC app said, "Hang on a minute. There's a problem with this case." Um, it could be that. I just don't know. I don't know what's going to happen. You'll have to

wait and see. But you'll know tomorrow. Um, so, you know, at least the pain doesn't have to continue for very much longer. All right, everybody. I think we've reached the end of the messages. So, I'll call that a day. Um, I may go live tomorrow. I don't know whether I'll go live tomorrow. If not,

I'll speak to you probably at the weekend. Um, and uh, fingers crossed for tomorrow. Let's hope it's a good day. Um and oh of course yeah we'll get the uh we'll get the judge's order in um from Judge Dilla I think tomorrow and um he will say something. I believe he'll say something after the hearing today. He

may choose to sanction the government and give us that 11 days. He may choose to go down a different path. He may choose to do none of that. Okay. Um he you know we have to wait and see. But I think he'll make some sort of order. um he's got other uh other potential

sanctions available to him. He can tell them off. It's kind of like the British police force. Um the British police force famously are not armed, right? So when they tell you to stop, you know, stop right now or I'll have to tell you again to stop right now. That's that's all the British cop can do typically. Um

they can just tell you to stop what you're doing or stop running away or whatever. That's pretty much it. That's all they can do. So the judge um you know could do some other things. They can they can find people. They can uh hold people in contempt. They can write a nasty email kind of thing. Um they

could do some other things. But I think Judge Deila is looking for uh a bigger he's clearly he's clearly recognizing the government um did not behave well and uh and believes he should do something if he can. The question is whether he believes he can or not. So, um you know, I think uh you have to hand

it to Curtis. I think he's made um the judge into a believer in some respect, just not all of it. Right. Um I don't think he's leaning towards the 40,000 reservation. Put it like that. All right, everybody. Um um oh you don't understand why the app DC reversal might still happen being allowed. Yeah

in time there's in time we could probably stop that nonsense right but we don't have time. So um it's pointless to try and argue and say hey you've you've got to stop using that DCF. It's just a pointless argument because you don't have time to have that argument. They had to focus on the most important

things and that's what Curtis did. Um, so you know whether we agree or not kind of irrelevant. That's what they did. All right everybody, we'll call that tonight. Thanks then. Bye-bye. Good luck for tomorrow. Fingers crossed. Let's be lots of good happy starfish tomorrow. All right. Bye-bye.
